Welcome to Vale of Ember Co.,LLC ("we," "us," or "our"). By accessing or using our website at valeofemberco.com (the "Site") and purchasing our products, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By using our Site, placing an order, or purchasing our products, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Site or purchase our products.

2. Eligibility

You must be at least 18 years old to make a purchase from Vale of Ember. By placing an order, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

3. Products and Services

Vale of Ember Co. offers handcrafted candles and wax melts made with natural tallow and beeswax and other handcrafted items. All product descriptions, images, and pricing are subject to change without notice. We reserve the right to limit quantities, discontinue products, or refuse service to anyone at our sole discretion.

4. Orders and Pricing

  • Order Acceptance: All orders are subject to acceptance by Vale of Ember Co. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.
  • Pricing: All prices are listed in U.S. Dollars (USD) and are subject to change without notice. We strive to ensure pricing accuracy, but errors may occur. If we discover a pricing error after you've placed an order, we will notify you and give you the option to proceed at the correct price or cancel your order.
  • Payment: Payment is due at the time of purchase. We accept major credit cards and other payment methods as displayed on our Site. By providing payment information, you represent that you are authorized to use the payment method.
  • Sales Tax: Sales tax will be applied to orders shipped to states where we have met the required sales tax collection threshold.

5. Shipping and Delivery

We currently ship to addresses within the United States only. Shipping policies, rates, and estimated delivery times are outlined on our Shipping Information page. Once your order is shipped, it is the responsibility of the carrier. We are not liable for delays, loss, or damage that occurs during shipping.

We offer local delivery within 20 miles from zip code 85937.

6. Returns and Refunds

Our return policy is detailed on our Return Policy page. We offer a 14-day return window for unused products in original packaging. Returns must be requested within 14 days of delivery. 

7. Product Use and Safety

Candle Safety: Our candles are intended for decorative and aromatic purposes only. By purchasing and using our candles, you agree to:

  • Never leave a burning candle unattended
  • Keep candles away from children, pets, flammable materials, and drafts
  • Trim wicks to 1/4 inch before each use
  • Burn candles on heat-resistant surfaces
  • Discontinue use when 1/2 inch of wax remains
  • Follow all safety instructions provided with your product

Wax Melts: Use only in approved wax warmers. Never leave warmers unattended. Keep away from children and pets.

Disclaimer: While our products are made with natural, allergy-friendly ingredients, individual sensitivities vary. We recommend patch testing if you have severe allergies. Vale of Ember Co.,LLC is not responsible for allergic reactions, injuries, or damages resulting from improper use of our products.

8. Intellectual Property

All content on this Site, including but not limited to text, images, logos, product descriptions, graphics, and designs, is the property of Vale of Ember Co.,LLC and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.

9. Custom Scent Orders

Custom scent requests are subject to availability and may take up to 2 weeks for production and curing. Custom orders are final sale and cannot be returned or refunded unless the product is defective or damaged upon arrival. By placing a custom order, you agree to these terms.

10. Limitation of Liability

To the fullest extent permitted by law, Vale of Ember Co.,LLC, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or Site, including but not limited to property damage, personal injury, or loss of profits.

Our total liability for any claim arising from your purchase or use of our products shall not exceed the amount you paid for the product in question.

11. Indemnification

You agree to indemnify, defend, and hold harmless Vale of Ember Co.,LLC and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our products, violation of these Terms, or violation of any rights of another party.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our Site or products shall be resolved in the state or federal courts located in Maricopa County, Arizona.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or purchase of products after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
